Agreement to Terms

By accessing and placing an order with Legacy Memorial Products, you confirm that you are in agreement with and bound by the terms and conditions contained below. These terms apply to the entire website and any email or other type of communication between you and Legacy Memorial Products.

Products and Services

Legacy Memorial Products offers custom memorial keepsakes and cremation ash receptacles. All products are made to order based on customer specifications provided through our Design Center.

Pricing and Payment

  • All prices are listed in US Dollars (USD)
  • Prices are subject to change without notice
  • Payment is required in full at the time of order
  • We accept major credit cards and other payment methods as indicated at checkout
  • All transactions are processed securely through our payment processor

Custom Orders

  • All Legacy Capsule products are custom-made based on your specifications
  • You are responsible for ensuring all text, designs, and specifications are correct before finalizing your order
  • Once an order is placed and production has begun, modifications cannot be made
  • Custom orders are non-refundable except as specified in our Returns Policy

Intellectual Property

  • You retain ownership of any custom designs or text you upload
  • By uploading designs, you warrant that you have the right to use such materials
  • You grant Legacy Memorial Products permission to use your designs solely for the purpose of creating your custom order
  • Legacy Memorial Products retains all rights to product designs, website content, and branding

Order Processing and Fulfillment

  • Orders are processed within 3-5 business days
  • You will receive order confirmation via email
  • Shipping times are estimates and not guaranteed
  • Legacy Memorial Products is not responsible for delays caused by shipping carriers
  • You are responsible for providing accurate shipping information

Shipping

  • We ship to addresses in the continental United States (48 states)
  • We do not currently ship to Alaska, Hawaii, or international destinations
  • Shipping costs are calculated at checkout based on destination and order size
  • Risk of loss and title for products pass to you upon delivery to the shipping carrier

Returns and Refunds

  • Due to the custom nature of our products, we do not accept returns or exchanges
  • We will provide a refund or replacement only in cases of:
    • Manufacturing defects
    • Damage during shipping
    • Products that do not match approved specifications
  • Claims must be made within 7 days of delivery with photographic evidence
  • Refunds will be issued to the original payment method within 10 business days of approval

Limitation of Liability

Legacy Memorial Products shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of our products or services. Our total liability shall not exceed the purchase price of the product.

Product Warranty

We warrant that our products are free from defects in materials and workmanship. This warranty is void if:

  • Products are damaged due to misuse, neglect, or accident
  • Products are modified or altered after delivery
  • Damage results from improper care or storage

Privacy and Data Protection

Your personal information is collected and processed in accordance with our Privacy Policy. By placing an order, you consent to the collection and use of your information as described in our Privacy Policy.

Communications

By creating an account or placing an order, you consent to receive emails from us regarding:

  • Order confirmations and updates
  • Shipping notifications

Disputes and Governing Law

These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

Severability
